Official Community Plan Amendment, Rezoning, Development Variance Permit and Subdivision Application at 4959 Linden Drive, Delta, BC


The Corporation of Delta sent the following information to residents regarding a development application received by the Community Planning & Development Department for the above noted property in your neighbourhood. The application is to permit subdivision of the property at 4959 Linden Drive into four bare land strata lots with common access for the lots to the rear from a private road off Linden Drive. A single family dwelling would be constructed on each lot. 

A location map which shows the subject property is provided in Attachment A.  Also included in Attachment A, is a project data table which shows proposed lot sizes and the maximum permitted house sizes. 

In order to proceed the following are required: 

  • Official Community Plan Amendment to exempt the subject property from the minimum 12 m (39 ft) lot frontage requirement specified in Policy D.5 of the Ladner Area Plan in order to allow a lot frontage of 9.2 m (30 ft) and 10.4 m (34 ft) for proposed Lots 1 and 4 respectively fronting Linden Drive; 
  • Rezoning from RS4 Single Family (610 m2) Residential to RS8 Single Family (390 m2) Residential; 
  • Development Variance Permit to vary Section 636E of “Delta Zoning Bylaw No. 2750, 1977” by reducing the minimum lot width from 13 m (43 ft) to 9.6 m (31 ft) for Lot 1, 12.8 m (42 ft) for Lots 2 and 3, and 9.9 m (32 ft) for Lot 4; and 
  • Exemption from the minimum 10% lot perimeter frontage requirement for subdivision under Section 512(1)(a) of the Local Government Act to allow the minimum required lot frontage for Lot 1 to be reduced from 10.4 m (34 ft) to 9.2 m (30 ft).
