G.  MOTIONS ON NOTICE

(G.01) Encroachment Policy
At the September 19, 2016 Regular Meeting, Councillor Kanakos provided the following Notice of Motion for consideration:

“WHEREAS Delta public municipal lands are owned in trust by Delta on behalf of Delta residents; and

WHEREAS Council has before it a number of encroachment issues on public, municipal lands; and

WHEREAS many municipalities have developed encroachment bylaws which protect the interests of residents in a fair and equitable manner.  For example, a bylaw could differentiate between where an encroachment does not impede public use or interest or where an encroachment contributes to the beautification. (For example, District of West Vancouver has had in place such a bylaw since 1982).

THEREFORE BE IT RESOLVED THAT Delta staff developa bylaw which outlines a policy and process for addressing encroachments throughout the municipality in a fair manner.”
