Proposed Rezoning, Development Variance Permit, Development Permit and Subdivision 4875, 4889, 4901 47A Avenue and 4770 48B Street


This is a new application that follows an earlier application proposed under File No. LU007171 for a three storey, 23-unit townhouse development at the above noted properties, which was denied by Council. The current application proposes changes to the form and character of the proposed buildings, reduction to the principal roof height and a review of on-street parking in the surrounding area.  The proposed density, siting, number of storeys, floor areas, floor plans, and resident and visitor parking for this application remains largely the same as previously proposed under File No. LU007171. 

In order to proceed the following are required: 

  • Rezoning from RM6 Multiple Family (Apartment 20) Residential to Comprehensive Development Zone No. 457;
  • A development variance permit to vary Part 7, Section 7.2 and Part 5, Section 33 of Schedule A of “Delta Subdivision and Development Standards Bylaw No. 7162, 2015” in order to reduce the required road dedication along 47A Avenue from 4.46 m (15 ft) to 2.46 m (8 ft) in order to maintain a modified arterial road standard of 10 m (33 ft) instead of 12 m (39 ft) from the centerline of the road, which would include a sidewalk adjacent to the curb and on-street parking; and 
  • A development permit to address the form and character of the proposed buildings, which would be located in the LV1 Ladner Village Development Permit Area. 


On July 28, 2015, Delta Municipal Council gave Third Reading to Bylaw No. 7457 in relation to this application. Bylaw No. 7457 would rezone the subject properties from RM6 Multiple Family (Apartment 20) Residential to Comprehensive Development Zone No. 457 and permit consolidation of the four subject properties in order to allow the 23-unit townhouse development.

Before Council is requested to give final consideration for adoption of Bylaw No. 7457 and approval for issuance of Development Variance Permit LU007503, the applicant must satisfy all the prerequisite conditions, including completion of required legal agreements, payment of outstanding fees and deposits, approval of engineering servicing requirements and other items identified in the Council Report dated June 29, 2015.

Community Consultation

A public notification letter about the proposal was sent on June 19, 2015 and public notice signs were installed on the site on June 23, 2015. A Public Hearing was held on July 28, 2015.
